What Is It

Perfection of Transfer (POT) and Perfection of Charge (POC) are the legal processes required to transfer a property's strata title from the developer's name to the homebuyer's name once the land office issues the individual strata title.

Who Is Eligible

  • Homebuyers of high-rise apartments, condominiums, or gated developments who purchased properties under a master title and have received notification from the developer that the strata title is ready.
  • Required Documents

  • Copy of MyKad.
  • Original Sales & Purchase Agreement (SPA).
  • Copy of the issued Strata Title.
  • Assessment receipt and latest maintenance fee receipt from the Management Office.
  • Original loan agreement and charge documents (if purchased via bank loan).
  • Step-by-Step Procedure

    1. Developer Notice: Receive notification from the developer/lawyer that the strata title is ready for transfer. 2. Appoint Solicitor: Hire a legal firm to prepare the Memorandum of Transfer (Form 14A under the National Land Code). 3. LHDN Stamping: The Form 14A is sent to LHDN for valuation and stamping. 4. Pay Stamp Duty: Pay the required ad valorem stamp duty fees. 5. Perfection of Charge: If there is a bank loan, the lawyer prepares Form 16A (Perfection of Charge) to register the bank's security interest. 6. Registration at Land Office: The lawyer submits the completed forms to the State Land Office for registration. 7. VOC Collection: Collect the printed Strata Title showing the buyer's name.

  • Cost: Professional legal fees (scale rate based on property value) plus ad valorem Stamp Duty. E.g., for RM400,000 property, stamp duty is around RM7,000.
