What Is It
The Strata Management Tribunal (Tribunal Pengurusan Strata - TPS) is a specialized tribunal established under the Strata Management Act 2013 to resolve disputes related to strata property management (e.g., apartments, condominiums, gated and guarded landed strata properties) without going through expensive civil courts.
Who Is Eligible
Strata property owners/purchasers.
Joint Management Bodies (JMB) or Management Corporations (MC).
Managing Agents appointed by the Commissioner of Buildings (COB).
Any person with a direct interest in strata management.
Common Disputes Handled
Failure of owners to pay maintenance fees or sinking fund contributions.
Inter-floor water leakage disputes (leaks coming from the unit above).
Disputes over house rules, renovations, or common property usage.
Failure to hold Annual General Meetings (AGM) or hand over accounts by the developer/JMB.
Required Documents
Form 1 (TPS): Statement of Claim form.
Strata Title / Sale & Purchase Agreement (SPA): Verification of ownership.
Invoices / Ledger Statement: (For fee disputes) Detailed account ledger.
Leakage Inspection Report / Photos: (For leakage disputes) Showing structural damage.
Correspondence: Copy of complaint emails or letters sent to the JMB/MC or neighbor.
Step-by-Step Procedure
1. Draft Claim: Fill out Form 1 online or at the TPS office counter.
2. Filing: Submit Form 1 with all supporting evidence and pay the filing fee. The TPS registry will stamp the form.
3. Serve Defendant: Deliver one stamped copy of Form 1 to the respondent (neighbor, JMB, or owner) within 14 days.
4. Response: The respondent has 14 days to submit Form 2 (Statement of Defence).
5. Hearing: Attend the hearing before the TPS President. Both parties present their case. No lawyers are allowed unless complex legal questions are involved and permitted by the Tribunal.
6. Award: The TPS President makes an order (Award) which carries the same weight as a Magistrate's Court order.
Cost & Processing Time
Cost: Filing fee is RM10 (for residential claims) or RM30 (for commercial strata claims).
Processing Time: The hearing is typically scheduled within 60 to 90 days from the filing date.

Tribunal Perumahan dan Pengurusan Strata (TPPS): Under the Ministry of Housing and Local Government (KPKT), Putrajaya, or state branches.
Important Notes
The maximum claim limit is RM250,000.
Failure to comply with a TPS Award is a criminal offense under Section 123 of the Strata Management Act 2013, carrying fines up to RM250,000 or imprisonment up to 3 years.
